1. Introduction and Acceptance

Welcome to Aeon. These Terms of Service ("Terms") govern your access to and use of the Aeon application, website, and related services (collectively, the "Service"), operated by Temporal Health LLC ("Aeon," "we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

2. Description of Service

Aeon is a general wellness application that provides lifestyle protocols designed to promote healthy habits across multiple domains, including sleep, movement, nutrition timing, stress management, and social engagement. The Service includes structured multi-week protocols, daily practice tracking, progress visualization, and personalized scheduling recommendations based on your self-reported preferences. Aeon is designed solely to support general lifestyle and wellness habits such as sleep routines, physical activity, stress management, and healthy daily behaviors, and is not a medical service. Aeon does not monitor medical conditions, perform health screening, provide risk scores for disease, or evaluate physiological signals for diagnostic purposes.

Certain recommendations provided by the Service may be generated through automated systems or algorithms based on your self-reported data and usage patterns. These automated outputs are informational and do not constitute professional advice or medical guidance.

We may modify, suspend, or discontinue features of the Service at any time. We do not guarantee that the Service or any specific feature will remain available indefinitely.

3. Important Health Disclaimer

Aeon is a general wellness product. It is not a medical device, diagnostic tool, or clinical service.

The Service does not provide medical advice, diagnosis, or treatment. The protocols, recommendations, and information provided through Aeon are for general wellness and informational purposes only. They are not intended to replace professional medical advice, diagnosis, or treatment. Participation in wellness practices suggested within the Service — including but not limited to changes in sleep schedules, meal timing, breathing practices, physical movement, cold or heat exposure, and other lifestyle interventions — involves inherent risks that may vary based on individual health status. By using the Service, you voluntarily assume all risks associated with participating in any activities or practices suggested by the Service.

You should consult your physician or other qualified healthcare provider before beginning any new health or wellness program, particularly if you have any pre-existing medical conditions, take prescription medications, are pregnant or nursing, or have concerns about whether the practices described in our protocols are appropriate for you.

Do not disregard professional medical advice or delay seeking it because of information you received through Aeon.

If you experience any adverse symptoms while following an Aeon protocol, discontinue the relevant practice immediately and consult a healthcare provider.

Aeon is intended solely for general wellness purposes as defined under the FDA's General Wellness Policy for Low Risk Devices. The Service is designed to support healthy lifestyle habits and does not diagnose, treat, cure, mitigate, or prevent any disease or medical condition. Aeon does not provide medical monitoring, medical alerts, or clinical decision support. The Service should not be used to make medical decisions. You are solely responsible for determining whether any lifestyle practices, protocols, or recommendations provided through the Service are appropriate for your individual circumstances. You acknowledge that health outcomes depend on numerous factors beyond the control of Aeon, including but not limited to genetics, underlying health conditions, adherence to practices, and environmental factors. You agree that you are responsible for all decisions related to your health and wellness.

Aeon is not intended for use in emergency situations or for monitoring acute health conditions. If you believe you are experiencing a medical emergency, contact emergency services or a qualified healthcare provider immediately.

Use of the Service does not create a physician-patient, therapist-client, or other professional healthcare relationship between you and Temporal Health LLC or its personnel.

4. Eligibility

You must be at least 18 years of age to use the Service. By creating an account, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

5. Account Registration

To use the Service, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

You may not create multiple accounts, share your account with others, or transfer your account to another person.

6. Membership Tiers

6.1 Free Trial

Aeon may offer a free trial period of thirty (30) days for new users. During the free trial, users receive full access to the Service. At the end of the trial period, your selected subscription plan will automatically begin unless canceled before the trial expires.

6.2 Standard Membership

After the free trial period, users may subscribe to the Service at $15.00 USD per month, billed monthly.

Prices are subject to change with 30 days' advance notice. Price changes will not affect the current billing cycle of existing subscribers.

6.3 Founder Pricing

Aeon may offer discounted Founder Pricing to the first five hundred (500) paying subscribers at $8.00 USD per month.

Founder Pricing is available on a first-come, first-served basis and remains in effect for as long as the subscriber maintains an active subscription without cancellation. Founder Pricing applies only while the subscription remains active and uninterrupted.

6.4 Billing and Renewal

Paid subscriptions automatically renew at the end of each billing period unless canceled before the renewal date. You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period — you retain access until then. Cancellation prevents future billing but does not result in a refund for the current billing period unless required by applicable law.

Refunds are handled in accordance with the refund policies of the platform through which you subscribed (Apple App Store or direct billing). We do not offer partial-month or partial-year refunds for cancellations made mid-cycle.

6.5 Price Changes

Promotional pricing, including Founder Pricing, may be discontinued for new users at any time.

6.6 App Store Billing

If you subscribe through the Apple App Store, billing and refunds are handled by Apple in accordance with Apple's App Store policies. Aeon does not control or issue refunds for purchases made through Apple.

You agree to use the Service only for its intended purpose — personal health and wellness tracking and improvement. You agree not to:

All content, protocols, algorithms, designs, text, graphics, software, and other materials available through the Service ("Content") are owned by Temporal Health LLC or our licensors and are protected by copyright, trademark, and other intellectual property laws.

Your membership grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Content for your personal, non-commercial use. This license does not include the right to reproduce, distribute, modify, publicly display, or create derivative works from the Content.

The Aeon name and logo are trademarks of Temporal Health LLC. You may not use these marks without our prior written consent.

9. User Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.

You retain ownership of the personal data you provide to the Service. You grant us a non-exclusive, worldwide, royalty-free license to store, process, analyze and use your data as described in the Privacy Policy, including for the purposes of providing the Service, personalizing your experience, and improving the Service through aggregate analysis.

Certain data you provide — including self-reported wellness metrics — may constitute sensitive personal information under certain privacy laws. Aeon processes this information solely to provide the Service and does not sell or share this information with third parties for cross-context behavioral advertising.

10. Data Collection for Product Improvement

Aeon collects and analyzes aggregate, de-identified user data for the purpose of product improvement and quality assurance. This includes analyzing protocol effectiveness, refining algorithmic recommendations, and improving the overall user experience.

This activity constitutes product improvement and internal quality assurance. It does not constitute scientific research, clinical investigation, or human subjects research. We do not publish findings in academic or scientific venues, and we do not make claims based on individual user outcomes.

Users may opt out of aggregate data analysis through their account settings without affecting their access to the Service.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT PROVIDED THROUGH THE SERVICE.

WE DO NOT GUARANTEE ANY SPECIFIC HEALTH OUTCOMES FROM USE OF THE SERVICE. INDIVIDUAL RESULTS VARY BASED ON NUMEROUS FACTORS INCLUDING BUT NOT LIMITED TO AGE, HEALTH STATUS, GENETICS, ADHERENCE TO PROTOCOLS, AND LIFESTYLE FACTORS.

THE INFORMATION, PROTOCOLS, AND CONTENT PROVIDED THROUGH THE SERVICE ARE INTENDED SOLELY FOR EDUCATIONAL AND INFORMATIONAL PURPOSES. YOU AGREE NOT TO RELY ON THE SERVICE AS A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE OR HEALTHCARE SERVICES.

RECOMMENDATIONS GENERATED WITHIN THE SERVICE MAY BE PRODUCED THROUGH AUTOMATED SYSTEMS OR ALGORITHMS BASED ON YOUR SELF-REPORTED INFORMATION AND USAGE DATA. THESE RECOMMENDATIONS ARE INFORMATIONAL IN NATURE AND SHOULD NOT BE RELIED UPON AS MEDICAL, HEALTH, OR THERAPEUTIC GUIDANCE.

AEON DOES NOT GUARANTEE PRESERVATION OF USER DATA AND USERS ARE RESPONSIBLE FOR MAINTAINING THEIR OWN COPIES OF ANY IMPORTANT INFORMATION.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TEMPORAL HEALTH LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

TO THE FULLEST EXTENT PERMITTED BY LAW, TEMPORAL HEALTH LLC DISCLAIMS LIABILITY FOR ANY INJURY, ILLNESS, ADVERSE REACTION, OR HEALTH OUTCOME ALLEGEDLY RESULTING FROM PARTICIPATION IN PRACTICES SUGGESTED BY THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

13. Indemnification

You agree to indemnify, defend, and hold harmless Temporal Health LLC and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

We may suspend or terminate your account at any time for violation of these Terms, with or without notice. You may terminate your account at any time through your account settings or by contacting us.

Upon termination, your right to use the Service ceases immediately. We may retain or delete your data in accordance with our Privacy Policy and applicable law. Where required by law, including under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), users may request deletion of their personal information.

Founder Pricing status is contingent on compliance with these Terms. Violation of these Terms may result in revocation of Founder Pricing status.

15. Dispute Resolution

15.1 Informal Resolution

Before filing any formal legal proceeding, you agree to attempt to resolve disputes informally by contacting us at support@temporalhealth.io. We will attempt to resolve the dispute within 30 days of receiving your notice.

15.2 Arbitration

If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its rules. Arbitration shall take place in Sonoma County, California. The arbitrator's decision shall be final and binding.

15.3 Class Action Waiver

You agree to resolve disputes with us on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration.

15.4 Exceptions

Nothing in this section prevents either party from seeking injunctive or other equitable relief in court for matters relating to intellectual property or unauthorized access to the Service. To the fullest extent permitted by law, both parties waive the right to a trial by jury.

16. General Provisions

Governing Law. These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions.

Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Temporal Health LLC regarding the Service.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.

Waiver. Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

Assignment. You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.

Force Majeure. Temporal Health LLC shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including but not limited to natural disasters, acts of government, internet outages, cyberattacks, labor disputes, or failures of third-party service providers.

Export Compliance. You may not use the Service in violation of U.S. export control laws or regulations, including by accessing the Service from jurisdictions subject to U.S. trade sanctions.

19. Apple App Store Terms

If you access the Service through the Apple App Store, the following additional terms apply: (i) Apple is not responsible for the Service or its content; (ii) Apple has no obligation to provide maintenance or support for the Service; (iii) In the event of any failure of the Service to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price for the application if applicable; and (iv) Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them.
